The National Defense and Security Council announced yesterday that a political party cannot continue to exist if it is organized throughout the Union and does not contest in at least one-fourth of all electoral constituencies.
This new regulation has been enacted in accordance with Article 427 of the Constitution of the Republic of the Union of Myanmar and modifies Sub-section (a) of Section 12 of the Political Parties Registration Law.
The amendment changes Sub-section (1) of Section 12 (a), which outlines the conditions under which a party may continue to exist. It now states: “(1) If a party is organized throughout the Union, it must contest in at least one-fourth of all constituencies of the Pyithu Hluttaw, the Amyotha Hluttaw, and the Region or State Hluttaw (including the constituencies of ethnic minority Hluttaw representatives) in the general election.”
Previously, the law required that “(1) If a party is organized throughout the Union, it must contest in at least half of all constituencies of the Pyithu Hluttaw, the National Hluttaw, and the Region or State Hluttaw (including the constituencies of ethnic minority Hluttaw representatives) in the general election.” This amendment reduces the required number from half to one-fourth.
